The cost-sharing trap

The CRA is blunt: "Rental losses are not allowed if your rental operation is a cost-sharing arrangement rather than an operation to make a profit."

Renting a room to a friend at the price of heat and hydro does not open the door to deductible losses. The operation has to aim at a profit.

Co-owner is not the same as partner

Form T776 has a separate part for details of other co-owners and partners. A simple co-ownership and a genuine partnership, which issues a T5013 slip, are taxed differently. When two people buy a plex together, that is one of the first questions to settle, not the last.

What this changes when buying a plex

The return quoted in a listing is a pre-tax return. Your actual return depends on your deductible expenses, your marginal rate and how ownership is structured. Two buyers can look at the same building and reach two different numbers, both of them correct.

Where this actually lands: at purchase, not after

These rules have one thing in common. They are not discovered while managing a building, they are discovered while buying one. A lease carrying a void clause, a deposit that was never lawful, a dwelling occupied by a succession, a subdivision project the law has suspended: each of those is sold along with the building.

That is why we read the leases, the building's tax position and the history of notices before making an offer on a plex, never after acceptance.
