The OACIQ's mandatory form Declarations by the seller of the immovable requires the seller to declare any unfavourable factor, including a past flood, infiltration, water-related insurance claims and the work done as a result. The seller's broker makes sure the facts and proof (invoices, photos) appear in it, and a flood between acceptance of the promise to purchase and the deed requires amending the declarations and informing the buyer. The buyer, for their part, requires proof (invoices, photos, reports), an inspection by a qualified professional and a check of the zone with the municipality and at the land register. A false declaration opens a recourse after the sale.
The form Declarations by the seller of the immovable is mandatory in any sale through a broker. Its water questions cover infiltration, floods, backups, damage and insurance claims, as well as the work done as a result. The seller's broker makes sure the facts and proof appear in the form, and checks with the municipality and at the land register whether the property is in a flood zone, and says so. The OACIQ recommends that a flooded owner document all consequences and measures taken, with proof: invoices, photos, videos.
A hidden flood is a hidden defect or a misrepresentation, depending on the case: the buyer can claim a price reduction, damages or cancellation, within the Civil Code's delays. For the seller, the complete declaration is the best protection: what is declared can no longer be hidden.
Yes: any known flood, whatever its date, is an unfavourable factor to declare, with the work done as a result.
The broker must amend the seller's declarations and inform the buyer; buyer and seller then discuss repairs, price or withdrawal under the promise to purchase.
It binds the seller on what they know or should have known. An owner who lived through a flood cannot claim to ignore it.
