The lease decides the home's value: its term, its rent, its rules and its assignment. What the Tribunal governs, and what the park decides.
In a mobile home park in Quebec, you own the home and rent the land: the Tribunal administratif du logement has jurisdiction over the lease of land intended for a mobile home; for mobile home parks, a rent adjustment item is provided for snow removal costs, according to the actual change in costs from one year to the next; a form “Adjustment to legal requirements, lease of land intended for the installation of a mobile home” exists. The rent renews and adjusts on the Tribunal's criteria, and a tenant who refuses an increase forces the owner to apply to set the rent. On resale, the buyer must take over the lease or sign a new one with the park. Financing depends on the lessor: since 25 October 2024, National Bank accepts mortgage financing applications for a mobile home on leased land, provided the lessor is a city or municipality, a mobile home park recognized by the Bank or Rio Tinto Alcan. The lease of a mobile home lot is therefore a residential lease: it renews, the rent adjusts on the criteria of the rent-setting regulation, and a tenant who refuses the increase within the delay forces the owner to apply to the Tribunal within the following month. You sell the home, not the land: the promise to purchase must be conditional on the assignment of the lease or the signing of a new lease with the park, and the price reflects the rent and the term of the lease as much as the home's condition. The seller's declaration covers the home; the lease and the park rules are handed over with it.
Since 25 October 2024, National Bank accepts mortgage financing applications for a mobile home on leased land, provided the lessor is a city or municipality, a mobile home park recognized by the Bank or Rio Tinto Alcan; a movable hypothec and an immovable hypothec on the home alone are registered, the lease must be in order and assigned if required (notice to notaries of 8 October 2024). The land lease is a residential lease under the jurisdiction of the Tribunal administratif du logement: the Civil Code's renewal and repossession rules apply, and a dispute is settled before the Tribunal, not by a letter from the park.

You can sell the home; the buyer, however, must become the land's tenant, by assignment of the lease or a new lease, as the lease provides. Make it a condition of the promise to purchase.
