There is no "official" commission rate in Quebec, and the percentage is the wrong question. Here is what is actually charged, who pays, what taxes add, and how to compare two offers on the net amount.

In Quebec, a real estate broker's commission (the law calls it "remuneration") is not set by any regulation: it is negotiated and written into the brokerage contract before the listing goes live. Typical rates on the South Shore and in Montreal run from 4% to 6% of the sale price, plus GST and QST (14.975%), and the percentage usually includes the buyer's broker's share. The seller pays, only if the sale closes, out of the sale proceeds at the notary; the buyer pays nothing. On a $600,000 house, 5% is $30,000 before tax and $34,492 with taxes; 4% is $27,594 with taxes. At Loaa and Manseur the rate is 5% all inclusive, with nothing to advance and no marketing fees. Reduced-rate formulas exist (seller finds the buyer, flat-fee mandates), generally with fewer services; the only number that matters is the net amount left after the sale, not the percentage.

What the law says

The Real Estate Brokerage Act and the OACIQ impose no rate: remuneration is agreed freely between seller and agency, written into the mandatory brokerage contract form with the percentage or amount, the way it is shared with a collaborating broker, and the cases in which it is due. It is payable only if the sale closes during the contract (or, depending on the clause, with a buyer introduced during the contract who buys within the following 180 days), and the notary deducts it from the proceeds. The seller advances nothing; the buyer pays nothing to the seller's broker, and usually nothing to their own, whose share is built into the seller's percentage.

How to compare two offers

On the price obtained, not on the percentage: a 4% broker who sells $20,000 under market costs more than a 5% broker who gets the price of comparable sales. Ask each broker for their last three sales in your sector with asking price, sale price and days on market; ask what is offered to the buyer's broker (too low reduces showings); ask what happens if you find the buyer yourself, if you cancel, and whether marketing costs are reimbursable. To give a current order of magnitude rather than a frozen example: according to the QPAREB, the median single-family home sold for $650,000 in the Montreal metropolitan area in August 2026 and $497,501 across Quebec. At 5%, the commission is $32,500 on the metropolitan median, or $37,367 with GST and QST, and $24,875 on the provincial median, or $28,600 taxes included. These amounts are deducted from the sale proceeds at the notary; they move every month with the median, and we update them with each QPAREB release.
